Terms of Service
These Terms of Service ("Terms") govern your use of the NeopolisGO mobile application (the "App"), operated by BYC Studio ("we", "us", "our"). By downloading, accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Acceptance of Terms
These Terms constitute a binding agreement between you and BYC Studio. We may update them from time to time; the "Last updated" date above indicates when they were most recently revised. Significant changes will be notified through the App. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
2. Eligibility
NeopolisGO is intended for users aged 13 or older (16 in certain European countries, in accordance with local requirements). By using the App, you confirm you meet this age requirement. If you are below the age of legal majority in your country, you may only use the App with the verifiable consent of a parent or legal guardian.
3. Account and Authentication
You may use NeopolisGO either anonymously, or by authenticating through Apple Game Center (iOS) or Google Play Games Services (Android). You are responsible for maintaining the confidentiality of any credentials associated with your account, and for all activity occurring under it.
We may, at our sole discretion, refuse, suspend or terminate accounts that violate these Terms or applicable laws.
4. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use, in accordance with these Terms and the applicable Apple App Store or Google Play Store terms.
You may not:
- Copy, modify, reverse-engineer, decompile or disassemble the App
- Distribute, sublicense, rent, sell, lease or transfer the App
- Use the App for any unlawful purpose or in violation of these Terms
- Use any automated tools, bots, scrapers or scripts to interact with the App
- Bypass, disable or attempt to circumvent any security or anti-cheat mechanism
5. Acceptable Use and Community Guidelines
When using the App, you agree to:
- Play fairly and not exploit bugs, cheats, modifications or unfair advantages
- Not harass, threaten, defame or discriminate against other players
- Not post obscene, hateful, illegal or copyright-infringing content (in usernames, in-game messages, or any user-generated content)
- Not attempt to gain unauthorized access to other accounts or our systems
- Not impersonate any person, including BYC Studio staff, moderators or other players
We reserve the right to moderate, edit or remove content, suspend participation in chat, or terminate accounts that breach these rules, without prior notice.
6. User Content
By submitting content (usernames, chat messages, corporation names, or any other input) through the App, you grant us a worldwide, non-exclusive, royalty-free license to host, display and use this content as needed to operate the App.
You retain all rights to your content but represent that you have the right to grant us this license and that the content does not violate any third-party rights or applicable laws.
7. In-App Purchases and Virtual Goods
NeopolisGO offers in-app purchases that allow you to acquire virtual items, in-game currency (Neocoins, Neocash) and other digital content. All purchases are processed by Apple App Store or Google Play Store, according to their respective terms.
You acknowledge and agree that:
- Virtual goods and in-game currency have no monetary value and cannot be exchanged for real-world money, goods or services outside the App
- Purchases are final and non-refundable, except where required by applicable law (notably for EU consumers, who retain their statutory rights)
- Refund requests must be addressed to the relevant platform (Apple or Google), as we do not directly handle payments
- We may modify, suspend or discontinue the availability of any virtual good at any time, without compensation
- Virtual goods are tied to your account and are forfeited if your account is terminated or deleted
8. Geolocation and Physical Safety
NeopolisGO uses your device's GPS to power location-based gameplay. You are solely responsible for your own safety while playing.
When using the App outdoors, you must:
- Remain aware of your surroundings at all times
- Comply with all applicable laws (traffic, trespassing, etc.)
- Not enter restricted, dangerous or private property
- Not use the App while driving or operating any vehicle
We are not responsible for any harm, accident, injury or property damage resulting from your use of the App in the physical world.
9. Intellectual Property
The App, including all of its source code, graphics, sounds, text, gameplay mechanics, names and trademarks (including "NeopolisGO" and the BYC Studio logo) is the exclusive property of BYC Studio or its licensors. All rights are reserved.
Nothing in these Terms grants you any ownership rights in the App or its content.
10. Termination
You may stop using the App at any time and request the deletion of your account by contacting us at contact@byc-studio.com.
We may suspend or terminate your access to the App, with or without notice, in case of breach of these Terms, fraudulent behavior, abuse of the service, or for any other legitimate reason. Upon termination, your account, virtual goods and gameplay progression may be permanently deleted, without compensation.
11. Disclaimer of Warranties
The App is provided "as is" and "as available", without warranty of any kind, either express or implied, to the maximum extent permitted by applicable law. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
12. Limitation of Liability
To the maximum extent permitted by applicable law, BYC Studio, its directors, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the App, including loss of data, profits, or virtual goods.
Nothing in these Terms limits any liability that cannot be limited under applicable law (notably consumer protection rights for EU users).
13. Apple and Google Terms
If you accessed the App through the Apple App Store, you acknowledge that these Terms are concluded between you and BYC Studio only — not with Apple — and that Apple is not responsible for the App or its content. The same applies to the Google Play Store and Google.
In case of conflict between these Terms and the platform's terms of use, the platform's terms prevail to the extent of the conflict.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of France. Any dispute arising from these Terms or your use of the App shall be submitted to the competent courts of Toulouse, France, except where mandatory consumer protection laws grant you the right to bring action before another court (notably for EU consumers).
